PLEASE READ THESE TERMS AND CONDITIONS OF SALE ("SALES AGREEMENT") VERY CAREFULLY.
BY VISITING, BROWSING, SHOPPING, ACCESSING OR OTHERWISE USING THIS WEB SITE (THE "SITE") OPERATED BY R&J Business Services Pty Ltd, trading as Ready Computing (Tas) ("www.shop4macandpc.com.au"), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
Important Information About This Legal Contract
This Sale Agreement is a legal contract between Shop4MacandPC, the online store of R&J Business Services Pty Ltd, trading as Ready Computing (Tas), hereinafter referred to as Shop4MacandPC, and the purchaser of goods or services, hereinafter referred to as "the Customer" or 'You'.
The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places an order will govern the order in question.
This Sale Agreement constitutes the entire agreement between the Customer and Shop4MacandPC relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by Shop4MacandPC. Electronic records (including signatures), that are otherwise valid, shall be accepted under the Sale Agreement. The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by sending an e-mail to admin@readycomputing.com.au.
These terms and conditions of sale shall, in all respects, be governed by and construed within the laws of the state of Tasmania. The customer acknowledges that no warranties or representations expressed or implied have been made by Shop4MacandPC to the customer in reliance upon which the customer has purchased these goods or services other than is expressed herein. Insistence by Shop4MacandPC upon a strict performance of any of the provisions of these terms and conditions shall not be deemed to be a waiver of its rights and remedies on any subsequent default by the customer in the performance or the compliance with any of the terms of these conditions.
Title; Risk of Loss
All items purchased from Shop4MacandPC are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier. Title to software will remain with the applicable licensor(s).
Pricing and Information Disclaimer
All pricing is subject to change and includes GST. All transactions are conducted in Australian Dollars. For all prices, products and offers, Shop4MacandPC reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances.
While Shop4MacandPC uses reasonable efforts to include accurate and up-to-date information on the Site, Shop4MacandPC makes no warranties or representations as to the Site's accuracy. Shop4MacandPC assumes no liability or responsibility for any errors or omissions in the content on the Site. Please contact the product manufacturer for any further details on the product or contact Shop4MacandPC before you purchase if you're unsure.
Limitation of Liability
Shop4MacandPC will not be liable for lost profits, loss of business or other consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. Shop4MacandPC will not be liable for products or services not being available for use or for lost or corrupted data or software. You agree that for any liability related to the purchase of products or services, Shop4MacandPC is not liable or responsible for any amount of damages above the aggregate dollar amount paid by You for the purchase(s) under this agreement.
Orders; Payment Terms; Interest; Taxes
1. Orders are not binding upon Shop4MacandPC until accepted by Shop4MacandPC.
2. The trading terms of Shop4MacandPC are cash by way of EFT funds transfer, credit card, Flexirent or Gift Certificate.
3. All costs of delivery are payable by the Customer.
4. Goods are supplied on the condition that they remain the sole property of Shop4MacandPC until paid in full. Title to the goods will pass to the Customer free and clear of all encumbrances upon payment in full.
5. In the event of default by the Customer, Shop4MacandPC shall (without prejudice to other rights) be entitled to repossess and/or resell the goods.
SHIPPING POLICY
1.When a customer requests the item to be shipped by Shop4MacandPC, then the customer is agreeing to use our courier for delivering the item. Shop4MacandPC will determine what shipping method to use based upon the item purchase. Once the item is shipped out, You will be notified with an email and its the customers own responsibility to be at home for the delivery. A card will be left at the front door if You missed the delivery and You must contact the number on the courier's card for re-delivery. If the item gets returned to Shop4MacandPC by the courier, Shop4MacandPC has the right to charge You a further shipping cost for the item to be re-delivered.
2.Shop4MacandPC endeavours to complete its commitment to the stated delivery schedule but cannot guarantee to meet scheduled delivery times on all occasions. Delivery times are indicative only and Shop4MacandPC does not accept any liability for failure to meet scheduled delivery times or any inconvenience caused as a consequence.
3.All shipping cost will be automatically calculated by our system. You can click on the "buy" button and shipping cost will be added before You confirm the order. Do not continue with the order if You do not agree to the shipping cost.
REFUNDS AND RETURNS POLICY
1.Shop4MacandPC offers a 'within 7-day of shipping of the product' return policy on all unopened products except those sold on a "No Return Basis". We also offer a return policy on products that are "Dead on Arrival", "Damaged in Transit" or "Incorrectly Shipped". Details of our "No Return Basis", "Dead on Arrival", "Damaged in Transit" and "Incorrectly Shipped" policies are provided under the section REFUNDS AND RETURNS POLICY that is found on the Shop4MacandPC.com.au's home page under the section on the right hand side entitled "Customer Service". Unless otherwise specified, the rights and benefits set out in this Refunds and Returns Policy are additional to all conditions, warranties, guarantees, rights, remedies and other terms expressed or implied under the manufacturer's warranty. Details of our manufacturer's warranty Refunds and Returns Policy are set out under the section REFUNDS AND RETURNS POLICY that is found on the Shop4MacandPC.com.au's home page under the section on the right hand side entitled "Customer Service".
2.Nothing in this Refunds and Returns Policy excludes, or purports to exclude, any warranties or conditions expressed or implied by legislation, that cannot be (or have not been) excluded by agreement. This Refunds and Returns Policy must be read subject to such warranties and conditions, and all references in this Refunds and Returns Policy to "statute" refer to statutory provisions that cannot be (or have not been) excluded by agreement. Shop4MacandPC HEREBY DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
3.Shop4MacandPC may, at its sole option, revise any part of this Refunds and Returns Policy from time to time without notice. Prices and availability are subject to change without notice. Typographical, product description, pricing, images and other errors are subject to correction, even after orders and/or payment are accepted. Shop4MacandPC does not guarantee product compatibility. Under certain circumstances, products will not be eligible for return, and not all products that are eligible for return are to be returned to Shop4MacandPC. Carefully review all return policies (REFUNDS AND RETURNS POLICY) before making Your purchase. Shipping charges may apply and are not refundable, except as otherwise provided under this Refunds and Returns Policy, manufacturer's warranty or other contract or statute.
